Lendo Platform PTE Limited referred to as “We” or “Lendo” are committed to safeguarding the privacy of our users.  This policy sets out how we may use your personal information when we request or hold personal information about you; how you can request access to a copy of your personal data and what you can do if you think the standards are not being met.

Our Privacy Policy is written in a way to be compliant with the recent European Union General Data Protection Regulation (GDPR). While the GDPR is a European Law, we are taking this opportunity to clarify and apply our privacy policy to everyone, no matter where you are located.

Definitions

“Data Controller” means the company (Lendo) responsible for the use of and the processing of personal information.

“Personal Data” means information relating to an individual who is or can be identified either from that information or from that information in conjunction with other information that is in or is likely to come into the possession of the Data Controller.

“Data Subject” – means an individual person who may be identified from the data we hold.

  1. Your Personal Data – What is it and what are your rights?

Personal Data relates to an individual person who may be identified from the data that we hold about them. Identification can be by the information alone or in conjunction with any other information in the Data Controller’s possession or likely to come into such possession.  The processing of Personal Data is governed by the General Data Protection Regulation 2016/679 (GDPR).

Unless subject to an exemption under the GDPR, you have the following rights with respect to your Personal Data:

  1. The right to request a copy of your personal data which we hold about you;
  2. The right to request that we correct any Personal Data if it is found to be inaccurate or out of date;
  3. The right to withdraw your consent to the processing at any time;
  4. The right to request that we provide the data subject with personal data and where possible, to transmit that data directly to another Data Controller;
  5. The right, where there is a dispute in relation to the accuracy or processing of your Personal Data, to request a restriction is placed on further processing;
  6. The right to object to the processing of Personal Data;
  7. The right to lodge a complaint regarding our processing of your data.

  1. What types of information does Lendo gather about its users?

 

  1. Information that you provideto us

We receive, store and process information that you make available to us when accessing or using the site. At various times you may give your Personal Data to us for example in order to enter into a contract with us we may need to know all or some of the following: your full name, date of birth, address, telephone number, email address, financial information etc. You may also provide Personal Data to us at other times, such as when registering on the site.  We may also gather information from cookies or web beacons.

  1. Mobile Data

When you use certain features of the Site, in particular any mobile applications, we may receive, store and process different types of information about your location, including general information (for example IP address, postcode etc.) and more specific information (e.g. GPS- based functionality on mobile devices used to access the Site or specific features of the Site).  If you access the Site through a mobile device and you do not want your device to provide us with location tracking information, you can disable the GPS or other location tracking functions on your device, provided your device allows you to do this.  See your manufacturer’s instructions for further details.

  1. Log Data

We may also receive, store and process “Log Data”, which is information that is automatically recorded by our servers whenever you access or use the Site, regardless of whether you are registered with Lendo or logged in to your Lendo account, such as  your IP address, the date, the time you accessed the site or use of the site, the hardware and software you are using, referring and exit pages and URL’s, the number of clicks, pages viewed and the order of those pages and the amount of time spent on particular pages.

  1. What are Cookies, Web Beacons and Clear GIF’s

A “cookie” is a small file placed on your hard drive by our web pages.  We or third parties under contract with us may use cookies to help us analyse our web page flow, customise our services, content and advertising, measure promotional effectiveness and promote trust and safety.  Cookies are commonly used at most major transactional websites in much the same way we use them on our Site.

You may delete and block all cookies from this site, but parts of the site will not work.

If you are only browsing the site, certain information (including computer and connection information, browser type and version, operating system and platform details and the time of accessing the Site) will be automatically collected about you. This information will be collected every time you access the Site and it will be used for the purposes outlined in this Privacy Policy.

We gather and share information concerning the usage of the Site with one or more third party tracking companies for the purpose of reporting statistics.  In this connection, some of the pages you visit on our Site use electronic images placed in the webpage code, called pixel tags (also called a “clear GIFs” or “Web Beacons”) that can serve many of the same purposes as cookies.

  1. Third Party Plug Ins

Our Site may use social plugins that are provided and operated by third-party companies such as Linked In, Twitter, Facebook, Instagram.  As a result of this, you may send to the third-party company the information that you are viewing on a certain part of our Site. If you are not logged into your account with the third-party company, then the third party may not know your identity.  If you are logged into your account with the third-party company, then the third party may be able to link information about your visit to our site to your account with them.  Similarly, a third party may record your interactions with the social plugin.   5. To compare information for accuracy and verify it with third parties;

  1. When Lendo discloses or shares Personal Information and to whom 

Your Personal Data will be treated as strictly confidential by Lendo.  By providing Personal Information to us as described in our Privacy Policy (for example in using our site and/or by using our services), you consent to sharing your Personal Data to Lendo Business Partners.  As per our contract with third party Business Partners they will only process and use your data in line with our contract with them and Personal Data will not be passed on to other third parties in accordance with their terms and conditions/Privacy Policy.  Should any third-party Business Party of Lendo be in breach of this, Lendo shall be indemnified from any claims, liabilities, damages, losses and expenses arising from any breach.

 

In addition to third party business partners, we may disclose your Personal Data in order to enforce our policies/contracts, or where permitted to do so by law, such as in response to a valid, legally compliant request by a law enforcement or governmental authority, or in connection with actual or proposed litigation, or to protect our property, people and other rights or interests.

  1. How Lendo secure, store and retain your data

We follow generally accepted standards to store and protect the Personal Data we collect, both during transmission and once received and stored, including utilisation of encryption where appropriate.

The majority of data is stored within the ‘EU’ with appropriate access controls regarding who has access to the servers and its data. We have a small amount of data that is held outside of the ‘EU’with a Lendo third party business partner.

We retain Personal Data only for as long as necessary to provide the Services you have requested and thereafter for a variety of legitimate legal or business purposes.  These may include certain retention periods:

  1. As required by law, contract or similar obligations applicable to our business operations;
  2. for preserving, resolving, defending or enforcing our legal/contractual rights; or
  3. where required to maintain adequate and accurate business and financial records.

  1. Business Transfers by Lendo

In the event that Lendo undertakes or is involved in any merger, acquisition, reorganisation, sale of assets, bankruptcy or insolvency event, then we may sell, transfer or share some or all of our assets, including your personal information.  Should any of the events as described take place, we will notify you before your Personal Data is transferred and becomes subject to a different Privacy Policy.

  1. Keeping your Personal Information Secure

We have implemented reasonable administrative, technical and physical security measures to protect your Personal Information against the unauthorised access, destruction or alteration of your information.  Additionally, we can confirm that our customer database is fully encrypted.  However, no method of transmission over the internet and no method of storing electronic information can be 100% secure.  So, we cannot guarantee the absolute security of your transmissions to us and your Personal Information that we store.

  1. Your Privacy when you access Third Party Websites and Resources

The site may contain links to other websites not owned or controlled by Lendo.  Lendo does not have any control over third party websites.  Third Party websites may place their own cookies, web beacons or other files on your device and they may collect Personal Information from you. They will have their own Privacy Policies in place and we encourage you to read the terms of use and Privacy Policies of the other websites that you visit.

  1. Changes to this Privacy Policy

We may change how we collect and then use Personal Information at any time and without prior notice, at our sole discretion.  We may change this Privacy Policy at any time.  If we make material changes to the Privacy Policy, we will notify you either by posting the updated Privacy Policy on the Site or by sending an email to you.  We will also update the “Last Updated Date” at the top of this Privacy Policy.  If we notify you of the changes to the Privacy Policy via email, then the date on which we send the email will be deemed to be the date of your receipt of that email.  It is important that you review the updated Privacy Policy and if you do not agree to the updated Privacy Policy, then we will not be able to continue using the site and you should deactivate your Lendo account.
